AI Governance for Healthcare: Where Clinical Safety Meets Model Risk
Healthcare AI governance is different from financial services AI governance in one fundamental respect: the consequences of a model failure are measured in patient outcomes, not in financial loss. A credit scoring model that underperforms costs the bank money. A clinical decision support tool that underperforms can harm a patient.
This difference shapes everything about how AI should be governed in healthcare, and most health systems have not yet built the governance machinery that accounts for it. They are running clinical AI initiatives through IT governance committees, procurement review boards, and ethics panels that were not designed for the specific risks that AI introduces into clinical workflows.
This post is a practical guide to building AI governance for healthcare that satisfies three audiences simultaneously: the clinical governance committee (which cares about patient safety), the information governance function (which cares about data protection), and the regulator (which cares about all of it under MHRA in the UK, FDA in the US, and the EU AI Act across Europe).
The regulatory landscape in 90 seconds
Healthcare AI sits at the intersection of three regulatory frameworks:
Medical device regulation. If an AI system makes or supports a clinical decision, it may be classified as a medical device (or Software as a Medical Device, SaMD). In the UK, the MHRA regulates SaMD. In the US, the FDA regulates SaMD. In the EU, the Medical Devices Regulation (MDR) and In Vitro Diagnostic Regulation (IVDR) apply. The classification determines the level of pre-market evidence required.
The EU AI Act. The EU AI Act classifies several healthcare AI use cases as "high-risk," including diagnostic AI, clinical decision support, and patient triage. High-risk systems face mandatory requirements around risk management, data governance, transparency, human oversight, accuracy, robustness, and cybersecurity. Health systems operating in or treating patients from the EU must comply.
National clinical governance standards. In the UK, the CQC inspects hospitals against clinical governance standards that include the management of new technologies. In the US, The Joint Commission and state licensing boards serve a similar function. These bodies expect to see that AI deployments have been through clinical risk assessment and are subject to ongoing clinical governance.
The NHS AI Lab has published useful guidance on navigating these frameworks. The key point is that healthcare AI governance must satisfy all three layers simultaneously, and most health systems are only addressing one.
The five principles
Based on our work in healthcare AI enablement, the governance model that works has five principles:
1. Patient safety is the binding constraint, not a review gate
Every design decision in a healthcare AI deployment must be evaluated against the question: "Does this improve patient safety, maintain patient safety, or create a new patient safety risk?" If it creates a new risk, the risk must be explicitly accepted by a named clinician with the authority to do so, and the acceptance must be documented.
This is not a bureaucratic requirement. It is the clinical equivalent of PRA SS1/23 model risk accountability: someone has to own the risk, and they have to be senior enough to be accountable for it.
2. Clinical autonomy means meaningful override, not rubber-stamping
The clinician must be able to override any AI recommendation without friction. But "override" must mean more than clicking "reject" on a pop-up. The override must be informed (the clinician has seen the AI's reasoning and the evidence it considered), structured (the override reason is captured in a field the model can consume), and tracked (override patterns are monitored and feed back to the model).
If clinicians override 90% of the AI's recommendations, the system is not working. If clinicians override 2% of the AI's recommendations and every override is rubber-stamped without review, the system is not safe. The governance framework must define acceptable override rate bands and trigger clinical review when the rate falls outside them.

3. Vulnerable patient identification is first-class
Under FCA Consumer Duty in financial services, vulnerable customer identification is a regulatory requirement. In healthcare, vulnerable patient identification is a clinical and ethical requirement that goes even further: patients with cognitive impairment, language barriers, mental health conditions, learning disabilities, or social isolation may interact with AI-assisted systems without the capacity to understand or challenge the AI's role in their care.
The governance framework must include explicit provisions for vulnerable patient identification, alternative care pathways for patients who cannot interact safely with AI-assisted workflows, and monitoring that detects whether vulnerable patients are experiencing worse outcomes than the general population.
4. Evidence as a by-product of clinical workflow
The governance framework must produce evidence of safe operation as a by-product of the clinical workflow, not as a separate documentation exercise. This means:
- Decision logs that record every AI recommendation, every clinician action, and every patient outcome in structured form
- Lineage from the source data through the model to the recommendation, queryable for any individual patient case
- Performance metrics (sensitivity, specificity, positive predictive value) computed continuously from production data, not from the original training set
- Adverse event reporting integration so that any AI-related patient safety incident flows into the national reporting system
This is the healthcare equivalent of the evidence-as-by-product principle from the AI enablement framework.
5. Regulatory classification drives the governance intensity
Not every healthcare AI deployment needs the same level of governance. A scheduling optimisation tool does not carry the same clinical risk as a diagnostic imaging AI. The governance framework must include a classification step that maps each AI use case to the appropriate regulatory tier (non-device / Class I / Class IIa / Class IIb / Class III under EU MDR, or equivalent under MHRA/FDA) and calibrates the governance intensity accordingly.
The EU AI Act's risk-based approach provides a useful overlay: minimal-risk AI gets light governance, limited-risk gets transparency requirements, high-risk gets the full framework. Mapping both the medical device classification and the EU AI Act risk tier for each use case ensures the governance is proportionate.
What the inspectorate will ask
When the CQC (or equivalent) inspects your AI governance, the questions will be:
- Which AI systems are in clinical use and what are they used for?
- Has each system been through clinical risk assessment?
- Who is the named clinical lead accountable for each system?
- How do you monitor whether the AI is performing safely in production?
- What happens when a clinician disagrees with the AI?
- How do you identify and protect vulnerable patients?
- Has the system been through the appropriate regulatory pathway (MHRA/FDA/CE marking)?
If you cannot answer these questions with documentary evidence, you have a gap. The World Health Organisation guidance on AI in health provides a useful ethical framework, and the NICE Evidence Standards Framework sets the evidence bar for digital health technologies in the UK.
Getting started
The practical first step is the same as in financial services: build the honest inventory of all AI systems in clinical and operational use, classify each against the medical device and EU AI Act frameworks, and identify the gaps in your current governance.
